Fenwick Elliott has strengthened its Eastern Europe coverage after forming an association with Bucharest firm SDC & Partners (Soimulescu Dragan Costin), Romania's first construction law specialist, in March 2010. With our combined resources, our firms have the largest and most highly rated construction law specialist teams in Romania, offering an integrated legal service to international clients operating or investing in the region.

SDC & Partners (Soimulescu Dragan-Costin) was established in 2005 as the first construction and engineering law specialist in Romania and has extensive experience in infrastructure and property development projects in Romania. All its senior lawyers specialize in construction law and have also developed specific experience in financing and banking, administrative, procurement and property law. SDC & Partners offer a service from project conception to completion and operation, working closely with consulting engineering teams, delay analysts and quantity surveyors.

This association is aimed at providing international clients with the benefit of both Fenwick Elliott’s extensive experience in international construction contracts and dispute resolution and SDC’s experience in construction law in Romania.

Our teams of lawyers are able to offer a comprehensive range of services on every aspect of the construction process, including: procurement strategy; contract documentation (construction agreements, bonds, guarantees, joint-venture agreement and consultancy contracts); BOT, PFI and PPP; project implementation; risk management and dispute avoidance; dispute management and resolution (including mediation, Dispute Adjudication Board (DAB) proceedings and arbitration). Some of Fenwick Elliott’s partners, including Nicholas Gould, also regularly sit as dispute board members in Romania.

Our lawyers have extensive experience of advising on all aspects of the suite of FIDIC contracts, and are used to working through the difficulties encountered in applying FIDIC contracts within a civil law environment. SDC lawyers are highly experienced in dealing with major employers in the public sector in Romania and understand the challenges which international contractors may have to face when tendering for and carrying out public works in Romania.
